before making your booking A
binding contract between us will be entered into
upon the Holiday Confirmation Form being issued a)
Making a Booking For all bookings including those
made by telephone the person confirming the booking
(the "Lead Name') must have authority to do so
on behalf of all the other people covered by the
booking and must have read and accepted these
booking conditions The Lead Name will be responsible
for the full cost of the holiday and cancellation or
amendment charges Once we have received your Booking
Form and all appropriate payments, subject to
availability, we will confirm the holiday by issuing
a Confirmation Invoice This Confirmation invoice
will be sent to the Lead Name, who must check the
Confirmation Invoice and all other documentation
sent by us as soon as they are received. If anything
appears to be incorrect the Lead Name must notify us
immediately as it may not be possible to make
changes at a later stage. No liability can be
accepted if the we are not notified of any
inaccuracies within 10 days of dispatching the
document in question b)
Payment Bookings and reservations shall only be negotiated on payment of a deposit of 25% of the accommodation rental. The balance must be paid not later than eight weeks prior to departure. If payment is not received in full and on time we reserve the right to treat the booking as cancelled by you. In this case the cancellation charges as set out will be payable. If we do not receive all payments
due and a signed Booking Form within 7 days of the
verbal confirmation of the booking the reservation
will be released. If you make a booking less than
eight weeks from the date of departure the full cost
of the property must be made prior to the issue of
the confirmation of booking. Receipt and banking of any deposit
shall not constitute acceptance of any booking c)
Changes to Bookings If you wish to make any changes to
the confirmed booking you must notify us in writing
as soon as possible. Whilst we will endeavour to
assist we cannot guarantee to be able to meet any
such requests. d)
Cancellation by You Should you need to cancel a
confirmed booking you must tell us in writing. This
notice of cancellation will only be effective when
we receive it in writing. We recommend that you use
recorded delivery. As we may be unable to re-let the
property, the following cancellation charges will be
payable by you. Where the cancellations charge is
shown as a percentage this is calculated on the
basis of the total cost payable by you.
Depending on the reason for
cancellation you may be able to reclaim these
cancellation charges (less any applicable excess)
from your insurance company. You must however pay
the cancellation charges due to us first. e) Changes and Cancellation by the
Company We
reserve the right to cancel your booking but only in
the following circumstances and on the following
terms i) At any time owing to Force
Majeure. Force Majeure means unforeseeable and
unusual circumstances beyond our control. Such
circumstances include but are not limited to war or
threat of war, riot, civil strife, industrial
dispute, unavoidable technical problems with
transport, ii) If at the due date you have failed to pay the full balance of the property letting price, in accordance with clause b), in which case cancellation charges as per clause d) will apply. f) Our Liability i)
We
accept responsibility for ensuring that all parts of
the holiday we have agreed to arrange, as part of
our contract, are provided to a reasonable standard
and in accordance with that contract. ii)
We
do not accept liability for any disappointment which
you may feel as a result of unrealistic
expectations. iii)
We
do not accept responsibility for the breakdown,
malfunction or failure of any electrical appliance. iv)
We
are only liable for death bodily injury or illness
arising as a direct result of the negligent acts of
our agents, servants, subcontractors and suppliers,
acting in the course of their employment and on our
business. v)
Any
claims made must be notified in writing to us within
7 days of return from holiday and shall be subject
to English Law. You must assign to us all rights
against any party to the claim and must give us and
our insurers full assistance in claiming against
such party. g) Damage A security deposit pledge will be
required in addition to the final payment. The
cheque for this deposit will not be cashed unless
charges are incurred. A separate cheque for the
final balance is also required payable to us.
Deposit cheques will be destroyed 28 days
after your return from holiday, unless deductions
have been advised in which case the balances will be
refunded. Such deductions will be advised no later
that 28 days after your return. All damage and breakages will be
charged to you and you must notify us or ‘HELP
UNLIMITES’
(whose details are on the notice board) immediately and before the property is vacated
so that repairs can be carried out as quickly as
possible. We must also be advised immediately on
return from the holiday. It is your responsibility
to ensure that you have adequate personal liability
insurance to cover any loss or damage to property
not owned to you. h) Promotional Accuracy We have made every effort to
ensure the information contained on our website is
accurate and correct. Pictures are intended to give
an overall impression rather than details of our
property. We are not liable for any items of
furniture or chattels which appear in the
photographs which may have been changed or removed
from the property and any aspects of the property
environment which may have changed since the
pictures were taken General Details Unless otherwise stated on the
Booking Confirmation Form the normal time of
occupation is after 3.00 pm of the arrival date and
the property must be vacated by 10.00 am on the
departure date Normal
weekly cleaning is included but a supplement will be
charged if the kitchen area and utensils are not
left clean. Linen and towels are changed weekly
unless otherwise stated on the Booking Confirmation
Form. Beach towels are not provided. Only
those people whose names appear on the Booking
Confirmation Form may occupy the property unless
otherwise agreed by us. Where satellite TV is concerned we make no guarantee of the channels available
